Information Omiq Collects

Information from third parties.

From time to time, we may use software from third parties who may gather information from you in order to fulfill their purpose. How Omiq Uses Information

Omiq uses the information that we collect in several ways. In general, we use information as in our judgment is necessary and appropriate in order to provide you our services, operate our site(s), and conduct our business. These uses include:

Business Operations

We use your information to operate our business, including performing accounting, billing and collection activities, security monitoring, crime and fraud prevention, improving the way the Services work, creating new features and functionality, protecting our legal rights, and performing our contractual obligations.

Communications.

We use your Account Information, including your name and email address, to communicate with you about the site and services, including customer support and for administrative purposes, such as notifying you of major Services updates, product updates, and Services offerings. Except for communications essential to our provision of the Services, you may opt-out of receiving communications from us.

How Omiq Shares Information

Omiq does not sell or rent your personal information to any other third party. Except as described in this policy, we will not knowingly disclose any personally-identifiable information that we collect or store in connection with the site or our services to any third parties without your consent.

Your organization.

As relevant based on specific subscription agreement, we share information with the organization that manages your account and/or subscription to the Services so that they may provision your account, administer your account, maintain security, view usage statistics, and access data associated with your account.

Public spaces.

If you post information, including personally-identifiable information, to an area accessible to other users or visitors of the website or which is addressed to mailing lists received by other users of the site or our services, that information will be available to other users of that service or visitor of that site who has access to it.

Law enforcement.

We may disclose information to third parties if required to do so by law; if served or presented with a court order, subpoena, warrant, or similar governmental order; or if we have a good faith belief such disclosure is required in order to cooperate with law enforcement or other governmental agency. Omiq affiliates.

We may share information that we collect within our corporate affiliates, including to our subsidiaries and parent companies, under the same conditions provided in this policy.

A change in ownership.

We may also share information we collect with any acquirer, successor or assignee of Omiq as a result of any merger, acquisition, sale of assets or similar transactions, or as the result of any bankruptcy or receivership. In such case, the recipient of the information will be responsible for compliance with the terms of this policy.

Service Providers.

We share information with our service providers to host our Services, provide website maintenance and security, to offer certain features on the Services, to assist us in improving the way the Services works and looks, and to create new features. These service providers may also be used to enable other features such as online payment, event registration and email and marketing management. We require that these parties agree to process such information in compliance with our Privacy Statement, we limit these service providers to information and data reasonably required to perform their functions and fulfill their obligations to us, and we assess these parties for their use of appropriate confidentiality and security measures.

Third party sites and services.

The site and our services may link to third party websites and other services. Information that you provide to these third-party sites and services is provided to the owners and operators of those sites and services, not to Omiq, and will be subject to the terms of use and privacy policies of those sites and services.

Non-personal information.

We may share aggregate, anonymized, de-identified, or otherwise non-personal information that does not directly or indirectly identify you and that cannot, with reasonable effort, be used to re-identify you in order to improve the quality and overall experience of our Services and other business purposes.

Protection of personally identifiable information

Our data security in general

We are concerned about the safety, security, and integrity of personally-identifiable information we collect and store. We have implemented, and maintain, commercially-reasonable and industry-standard administrative, technical and physical safeguards to protect your personally-identifiable information against unauthorized use and disclosure including: firewalls, SSL technology to encrypt data during transmission, and password protection and other authentication controls.

When personally-identifiable information is stored by Omiq, we keep the information on computer systems we own or manage that are protected in one or more of the following ways: the systems have limited access, the information is protected by passwords, or the information stored on encrypted disks.

However, we cannot guarantee the protection or secrecy of any information you post to open areas of the site or our services, such as forums or email lists, which are accessible by other users and visitors. You should take care to guard private and personal details when using these features.

Any information that you choose to share on any publicly available portion of the Services or with third parties may be collected and used by such parties.

In addition, the Services’ functionality may make your User ID accessible to other Users (e.g., as associated with any data files you upload to the Services). If you associate your actual name or other personally identifiable information with your User ID, the persons to whom you have revealed your name may be able to identify your activities on the Services.

Omiq Administrators

Omiq administrators may have access to your account information, including your email address. Specifically, your administrator may:

  1. View statistics regarding your account, such as information concerning your last login or data storage usage;
  2. Change your account password, suspend or terminate your account access and your ability to modify your account;
  3. Access or retain information stored as part of your account, including your email, contacts and other information; and, retrieve account information in order to satisfy applicable law, regulation, legal process or enforceable governmental request.

Use of Cookies

When you use the Services, we may send one or more “cookies” (a small piece of data sent from a website and stored on the user's computer by the user's web browser while the user is browsing) to your computer. Omiq may use both session cookies and persistent cookies to anonymously track unique visitors. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to the Services. By using these cookies, we can remember what you have done on the Services before and personalize our site for you.

You have the option to reject or remove these cookies using your web browser, but disabling cookies may prevent you from accessing some of the functionality available via the Services.

Omiq as Information Controller / Processor

Except as set out in this policy, Omiq is the “Processor” and “Controller” (as defined in the EU General Data Protection Regulation) of personally-identifiable information collected from the site and our services. The personally-identifiable information we collect is processed and stored on systems and servers operated in the United States that are operated or controlled by Omiq.

For information we control and process, you may contact us to request that (i) we provide you with a copy of your personally-identifiable information; (ii) we update, rectify, or correct your personally-identifiable information; and/or (iii) we delete copies of your personally-identifiable information. Within a reasonable time after that request, we will take reasonable steps to comply with your request to the extent feasible.

You have access to and may be able to update, correct, or delete your information and preferences at any time by going to the Account Settings section of the Services. Contact us to edit or delete any information that cannot be modified by you directly.

You may decline to share your personally identifiable information with Omiq, in which case Omiq will not be able to provide to you some or all of the features and functionality found on the Services.

To protect your privacy and security, we take reasonable steps to verify your identity before granting access to your account. You are responsible for maintaining the secrecy of your account and password at all times.

Required California privacy disclosures

Direct marketing.

We do not knowingly share personally-identifiable information with third-parties for direct marketing purposes.

Do Not Track.

We do not track visitors or users of the site or our services over time or across third party websites for the purposes of targeted advertising. Therefore, we do not respond to do-not-track (DNT) signals.

Minors.

We do not believe that the site or our services are directed to children under the age of 18 and we do not knowingly collect personally-identifiable information from children. If you are under 18 years of age, please do not use the site or our services. If we become aware of any personally identifiable information of a user under the age of 18, we will take reasonable steps to delete this information.
